13 THE MORNING OKEGONIASF, SATURDAY, MARCH 26, 1904. ORDERS ATTORNEY OUT MUNICIPAL JUDGE AND JOHN F. LOGAN CLASH. Objections to Court's Questions In Cruelty-to-Animal Case Lead to Exciting Incident. Attorney John F. Logan and Officer Hammersley marched from the Police Court yesterday morning, the attorney leading' the procession and the policeman formlnjr the rear-guard. Municipal Judge Hogue -directed the proceedings, issuing orders that Attorney Logan snouia nut come to a halt before he had reached the outer limits of the courtroom doors. It should be stated at the outset that the court was mad. He had lost his temper because the attorney had objected to number of questions he -was putting to a nritnesR for the defense. In a case At- tnmev Locan was defending. it tou are asklntr those questions on "behalf of the state, I object, and Jf you -are asking- them in behalf of the defense T -crffih to sav I do nbt desire them," At torney Logan had said, and this was what had brought the magistrate's wrath upon him. After Attornev Logan had declined pressing -Invitation to seat himself and bad insisted upon making himself heard the military display was started by Judge "Attrrrne-r Locan. TOU Will leave the mom. " ordered his honor. "Officer Ham mersley conduct Mr. Logan from the room," added the court when the attorney iA not obev on the instant. -Mr. Logan then gathered up his coat and ir.t and other accoutrement, executed an aljout-face and led the procession in Bingld file, passing in review before the cnootninrs' bench and nasslng out the door. Officer Hammersley came to a halt just Inside the outer railing, faced about and returned to his post as soon .as the other portion of the detachment had disap peared. After staying out in the cold a few minutes Attorney Logan returned to find that the court's ire had cooled and that ho was indeed quite welcome to re main. He continued with his case and the proceedings were concluded with all tranquility. , tvio nsft in nuestlon was that of tne State against F. D. Stuart, manager of a delivery company, who was charged with n his VivMo The man had sev- Sal witnesses on hand to establish that it Is not cruel to prod a horse witn a I half-inch awl attached to the end of a I One. F. O. Armstrong, wo u that he was a horsedoctor, was the star witness. He gave testimony to the effect that thrusting the weapon into the horse was not any more cruel than usulng t-nrr, tta oisn said he had examined the horse' in question and had found no marks j of abuse. It was after ne got wiouku that Judge Hogue essayed to question him on his views of cruelty and got in the miv.im -with Attorney Logan. The brunt of the testimony for the de fense was that back in the woods of Mln nesota these goads, like Stuart used on vmrQf. nrft resrarded with favor. As- cictnnt District Attorney Adams took oc- easlon to remark that the devices were undoubtedly about as humane as a bull fight, and suggestea wmx u. u be allowed In Portland It would hardly be fair to restrict bullngnting. 1 The case was nnaiiy postponed unui 1 Anril 5 in order that Stuart may nave imo in tphicii to tret a siaremeni uum the Minnesota Humane Society as to how thev regard these goads, too court an nounced' his desire to give Stuart every reasonable chance to deiena nimseu, as he intends to send him to the County Jail If convicted of the charge. In his suit, Blum charges tnat tne promoters oi the Distilling Company, wnicn is capital Ized at 5125,000,000, made large profits out of the promotion at the expense of tho eomoanv. The- defendants set up the plea that Blum is merely a figurehead, being a broker's clerk 21 years old, and moved that he should be examined before the trial to ascertain the real promoters of the suit in order that the defendants might properly answer. In the affidavits on which the order for Blum's examination was asked, the de fendants allege that Nathan Bljur has more than an indirect Interest in the liti gation. Mr. Bljur made application to have the parts of these affidavits referring to him stricken from the records on the ground that they are scandalous. Judge Glldersleeve refused this application and now has denied Blum s motion to vacate the order. No date was set for Blum's examination. Those named In the suit are the late "W. C "Whitney.
